Radha’ah and Hadhanah from the Perspective of the Qur’an and Hadith: A Juridical-Normative Analysis of Children’s Rights

This study examines the concepts of Radha’ah and Hadhanah within the normative framework of the Qur’an and Hadith. Amid modern social dynamics characterized by rising divorce rates and women’s dual roles as mothers and workers, a comprehensive understanding of children’s rights has become crucial. This study employs a qualitative method using a literature review (library research) and thematic analysis of relevant Qur’anic verses and hadiths. The results of the study indicate that Radha’ah not only regulates the fulfillment of a child’s nutritional needs but also establishes kinship relationships (mahram) that carry permanent legal implications. Meanwhile, Hadhanah is positioned as a fundamental right of the child (haqq al-mahdhun) to receive the best care, where the child’s interests and well-being serve as the primary benchmark (maslahah al-thifl), superseding the self-interested rights of the parents. The main argument of this article is that the Qur’an and Hadith provide a flexible, child-centered ethical and legal framework. These principles, when interpreted contextually, can offer just solutions to contemporary issues such as child custody disputes and the challenges faced by breastfeeding mothers in public spaces.
